What is our policy on privacy?
At EUROPERFUMERY LTD, we are committed to protecting your privacy. When you place an order with us we need to know your name, email address, telephone number, delivery address and payment details. We collect information about you for 2 reasons: firstly, to process your order, and second to keep you up to date with its progress.
We also want to be able to inform you of any product updates or promotions. Accordingly www.1Perfumery.co.uk may choose to contact you by email with our newsletter, packed with new product information, competitions and special offers. If you don't want to receive the newsletter, then please remove the tick from the box on the delivery details page by clicking on it. We will not sell, loan, or share any information regarding our customers to any third parties unrelated to EUROPERFUMERY LTD or its affiliated companies.
You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly. The Internet is not a secure medium but we have put in place various security procedures to keep your personal information confidential. These cover the storage, access and disclosure of your information. By submitting your information, you consent to the use of that information in accordance with our privacy policy. § 1. Basic Provisions

  1. The following terms and conditions apply to all contracts between EUROPERFUMERY LTD (220C, BLYTHE ROAD, W14 0HH LONDON UK) – hereinafter referred to as the provider – and the customer, which are concluded via the website 1perfumery.co.uk Unless otherwise agreed, the inclusion of the customer’s own terms and conditions is hereby rejected.
  2. A consumer within the meaning of the following provisions is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or independent professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their independent professional or commercial activity.
  3. The contract language is German. The contract text is stored by the provider. However, the storage is only temporary, so the customer is responsible for printing or separately saving the contract themselves.

§ 2. Prices, Shipping Costs

The prices listed in the respective offers, as well as the stated shipping costs, are final prices. They include all price components, including all applicable taxes. If delivery is made to a non-EU country, additional customs duties, taxes, or fees may be payable by the customer, but not to the provider, rather to the competent customs or tax authorities in that country. The customer is advised to inquire about the details from the customs or tax authorities prior to placing an order. The incurred shipping costs are not included in the purchase price. They are determined by the respective specific offer and the information provided therein about shipping, will be displayed separately during the ordering process, and must be borne by the customer, unless free shipping has been promised.


§ 3. Subject of the Contract
The subject of the contract is the sale of goods. The details, in particular the essential characteristics of the goods, can be found in the product description and the supplementary information on the provider's website.

§ 4. Conclusion of the Contract
Clicking the buttons "Buy Now", "Bid", or "Make an Offer" on the product pages, or "Review Offer" or "Send New Offer", does not yet constitute a binding contractual declaration. The customer still has the opportunity afterwards to review their entries and correct them using the browser's "Back" button or to cancel the purchase. This option is no longer available once the binding contractual declaration has been made.

§ 5. Payment and Shipping Terms

1. The customer has access to the payment options specified in the specific offer. Cash payment and collection of the goods are possible if explicitly mentioned in the item description. The purchase price plus shipping costs must be paid no later than 3 days after receiving the payment request. If payment on account is permitted in the item description, the amount is due 14 days after receipt of the goods and the invoice.

2. The delivery of goods is limited to the countries explicitly listed for the individual items or in the shipping terms. Unless otherwise specified in the item description, delivery of the goods will occur within 3-5 working days after the contract has been concluded. In the case of advance payment, delivery will only take place after the full purchase price and shipping costs have been received.


3. As a consumer, the customer is requested to immediately check the goods upon delivery for completeness, obvious defects, and transport damage and to promptly notify the provider and the carrier of any complaints. The customer’s warranty claims remain unaffected by this. If the customer is a consumer, the risk of accidental loss and accidental deterioration of the sold goods passes to the customer upon delivery of the goods, regardless of whether the shipment is insured or uninsured. If the customer is a business entity, the delivery and shipment are at the customer’s risk.

The ordered goods will be shipped within 2 business days after receipt of payment.

Credit Card: When paying by credit card, the customer is automatically redirected to the credit card payment system, where they enter their personal credit card information via a secured 128-bit SSL connection. Upon successful completion of the credit check and approval by the credit institution, the payment is processed immediately. In the case of the first payment by credit card, registration in the MasterCard Secure Code system or the Verified by VISA system is required before the payment is made. The customer will be redirected to the respective websites for this process. This procedure is mandated by MasterCard and VISA and cannot be influenced by EuroPerfumery.


§ 6. Return Shipping Costs When Exercising the Right of Withdrawal

In the event that the statutory right of withdrawal applicable to consumers in distance contracts is exercised, it is agreed that the customer shall bear the regular costs of return shipping if the price of the item to be returned does not exceed 40 euros or, in the case of a higher-priced item, if the customer has not yet rendered the consideration or a contractually agreed partial payment at the time of the withdrawal, unless the delivered goods do not correspond to the order. In all other cases, the supplier shall bear the costs of return shipping.

§ 7. Set-off and Right of Retention

    The customer is only entitled to set-off if the counterclaim is undisputed, legally established, or acknowledged by the supplier.
    The customer may only exercise a right of retention insofar as it concerns claims arising from the same contractual relationship.

§ 8. Warranty

  1. The statutory provisions apply.

  2. For used goods, the warranty period deviates from the statutory regulation and is one year from the delivery of the goods. The one-year warranty period does not apply to damages attributable to the provider caused by injury to life, body, or health, or to damages caused by gross negligence or intent.

  3. If the customer is a business, the following applies, deviating from paragraph 1:

    a. Only the provider's own specifications and the manufacturer's product description are considered as agreed upon regarding the condition of the goods. Other advertising, public promotions, and statements by the manufacturer are not considered as agreed upon.

    b. The customer is obliged to inspect the goods immediately and with due diligence for quality and quantity discrepancies and to notify the provider in writing of any obvious defects within 7 days of receiving the goods. Timely dispatch is sufficient to meet the deadline. This also applies to hidden defects that are discovered later, from the time of their discovery. Failure to comply with the inspection and notification obligation excludes the assertion of warranty claims.

    c. In the case of defects, the provider shall, at their discretion, provide warranty through repair or replacement. If the defect remediation fails twice, the customer may choose to request a reduction in price or withdraw from the contract. In the event of repairs, the provider is not obliged to cover the increased costs that arise from the transfer of the goods to a location other than the place of performance, provided that the transfer does not correspond to the intended use of the goods.

    d. The warranty period is one year from the delivery of the goods. The shortened warranty period does not apply to damages attributable to the provider caused by injury to life, body, or health, or to damages caused by gross negligence or intent.
     

    § 9. Retention of Title

  1. The goods remain the property of the supplier until full payment of the purchase price has been made.
  2. If the customer is an entrepreneur, the following additional provisions apply:
  • a. The supplier retains ownership of the goods until all claims arising from the ongoing business relationship have been fully settled. Before the transfer of ownership of the goods subject to retention of title, pledging or assigning them as security is not permitted.
  • b. The customer may resell the goods in the ordinary course of business. In this case, the customer hereby assigns to the supplier all claims in the amount of the invoice total that arise from the resale. The supplier accepts this assignment. The customer remains authorized to collect the claims. However, if the customer fails to meet their payment obligations properly, the supplier reserves the right to collect the claims themselves.
  • c. If the goods subject to retention of title are combined or mixed with other items, the supplier acquires co-ownership of the new item in proportion to the invoice value of the goods subject to retention of title to the other items processed at the time of processing.
  • d. The supplier undertakes to release the securities to which they are entitled at the request of the customer to the extent that the realizable value of the supplier's securities exceeds the claim to be secured by more than 10%. The selection of the securities to be released is at the discretion of the supplier.

§ 10. Liability

  1. The provider is fully liable for damages arising from injury to life, body, or health, insofar as the provider has fraudulently concealed a defect or has assumed a guarantee for the quality of the purchased item, in all cases of intent and gross negligence, for damages under the Product Liability Act, or where otherwise required by law.
  2. If essential contractual obligations are affected, the breach of which endangers the achievement of the contractual purpose, the provider's liability for slight negligence is limited to the typical, foreseeable damage under the contract.
  3. In the case of breaches of non-essential contractual obligations, liability for slightly negligent breaches of duty is excluded.
  4. Data communication over the Internet cannot be guaranteed to be error-free and/or available at all times according to the current state of technology. The provider is therefore not liable for the continuous or uninterrupted availability of the website and the services offered there.

§ 11. Contract Cancellation

CANCELLATION WITHOUT STATING REASONS (RETURN OF GOODS)
Not satisfied with the product? With us, you don’t have to worry about choosing perfumes and cosmetic products, as you can cancel the purchase contract without giving any reason within 90 days.

When can I cancel the contract without stating reasons?

The right to cancel the contract does not apply to the following contracts:
a) Contracts for the supply of goods that are not prefabricated and for the production of which an individual choice or specification by the consumer is essential, or goods that are clearly tailored to the personal needs of the consumer.
b) Contracts for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

In cases where the goods have been gift-wrapped or packaged ecologically, it is also not possible to cancel the contract for the gift or ecological packaging service once the goods have been wrapped, and the service has been provided. Please note that we pack the goods for you immediately after the order.
Furthermore, it is not possible to cancel a contract for gift wrapping of goods once the goods have already been wrapped. We would like to point out that under applicable law, you are liable for any depreciation in the value of the goods if you handle the goods in a way that goes beyond what is necessary to establish their nature, characteristics, and functioning (e.g., if you continue using a perfume after the first trial). In such a case, we may only refund a partial amount of the purchase price.

How do I proceed if I want to cancel the contract without stating reasons?

Simply inform us within 90 days of your decision to cancel the contract. The best way to contact us is by sending an email to info@1perfumery.co.uk To make a return, you must fill out the return form, which can be downloaded HERE.

Registered customers have the option to report product returns directly through their customer account. Simply select the products you wish to return in the My Orders section. You can also track the status of your return in the account.
The customer bears the cost of returning the goods.
If you have received additional goods from us free of charge (“gift”) in connection with the purchase contract, you must also return this gift.

We will refund the purchase price within 14 days at the latest from the date of contract cancellation. According to the law, we may also wait with the refund until you have returned the goods to us. If you cancel the contract within 14 days of delivery, you are also entitled to a refund of the delivery costs for the goods up to the amount corresponding to the cheapest delivery method. In the case of free shipping, no costs can be refunded, as no delivery costs were incurred by you. The customer bears the shipping costs for returning the goods.
 

§ 12. Complaint

Even though the proportion of faulty products among the goods we deliver is minimal, it's worth knowing that we will promptly and satisfactorily address any defects. We are always interested in resolving any issues as quickly as possible, so you don't have to worry about waiting longer than necessary (usually the process only takes a few days).

When can I file a complaint?
We are liable for defects present in the goods at the time of delivery and for defects that arise within the next 24 months. However, we are not liable for new defects, especially those caused by improper use. For used goods, we are not liable for defects corresponding to the degree of use or wear and tear that the goods exhibited when they were returned. For goods with a marked expiration or usability date, we are also liable for ensuring that the goods remain usable within the specified time frame.
Please note that increased sensitivity or allergic reactions to the delivered goods cannot be considered a product defect. Likewise, defects in gifts or other complimentary services provided beyond the scope of your order cannot be considered a product defect. The images displayed in our online shop are for illustrative purposes only and do not represent a binding depiction of the product's properties (e.g., the packaging may differ if the manufacturer changes it).

What rights do I have in the event of a complaint?
If the goods exhibit defects, we may agree to compensation in the form of a voucher.
You are also entitled to request that the defect be rectified through a replacement or repair.
If such rectification is not possible or reasonable for us, you are entitled to request a reduction in the purchase price. In this case, you keep the goods, and we refund part of the purchase price. If it is a significant defect, you can also withdraw from the contract. In this case, you send the goods back to us, and we will refund the full purchase price.

How do I file a complaint correctly?

If you decide to file a complaint, please send the goods together with the completed complaint form to info@1perfumery.co.uk

Registered customers can report product returns directly through their customer account. Simply select the products you wish to complain about in the "My Orders" section. You can also track the status of your return through your account.
Please don't forget to specify the nature of the defect or how it manifests and, if applicable, what type of resolution you are requesting.
We will keep you informed about the status of your complaint, particularly regarding its receipt, resolution, or rejection, in writing either via email or SMS. You can also contact us by phone.
A decision regarding your complaint will be made promptly. The resolution of the complaint, including rectification of the defect, should generally not exceed 30 days. Otherwise, you have the right to withdraw from the contract. Your cooperation is essential to ensure this deadline is met.
In the event of damage or partial loss of contents, we recommend that our customers keep the entire packaging as proof of the complaint for at least 5 working days. Photographic evidence can expedite the resolution process.

Privacy Policy
We inform you that any data transmitted by you during business transactions will be processed and stored using a computer system. Personal data will, of course, be treated confidentially.

Payment and Payment options
What are the different ways I can pay? We accept payment via credit and debit cards. However you want to pay, we must receive payment of the whole of the price of the goods you order before your order can be accepted. Our acceptance of your order brings into existence a legally binding contract between us.
Paying by Credit/Debit Card (Off-line) Customers not wishing to purchase items by credit card on line (see Security section) may wish to print our their order form and fax or mail it to us instead.
Personal Cheque Customers can choose to pay by personal cheque. To do so simply print out your order form and mail it to us along with your cheque. Perfume Shopping can only process cheques denominated in pounds Sterling and drawn on an UK bank.
Customers should note that orders placed by cheque would only be sent to the customer once the cheque has cleared. Therefore, orders may be delayed by 8 to 10 days.

Delivery and Delivery Charges
We ship all orders via GLS recorded delivery. All European orders are delivered by GLS.
European countries where we deliver include: Austria, Belgium, Bulgaria, Czech Republic, Denmark, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden. We do not ship international or to other European destinations.

EUROPERFUMERY LTD strives to satisfy the customer and offer the highest levels of quality and service. If for any reason you are dissatisfied with our product, simply follow the directions below to return the order within 10 days of purchase date and we will promptly process your request and refund your money. Please ensure the product is in all its original packaging and has not been used. Send the items back to;

Please contact our customer service team before returning any item. Unfortunately we cannot refund postage unless the goods were faulty at the time of delivery or the order was incorrect. We advise that you send items back by either recorded or special delivery.

We will not be liable to you for any failure to deliver goods or delay in doing so or for any damage or defect to goods delivered where the failure, delay, damage or defect is caused by any event by circumstance beyond our reasonable control (including, without limitation, strikes, lock-outs, and other industrial disputes).
